The Chairman made the following announcements:

 

1.       The Chairman reminded Members of the remote meeting etiquette and asked all Members to ensure they complied with the protocol.           

 

2.      The Chairman explained that in light of this being a virtual meeting the arrangements for public participation had been slightly amended to facilitate the process whilst still ensuring public participation was possible.  A pre-recorded address would be played, or a written statement would be read by the Chairman at the appropriate time in lieu of members of the public speaking in person during the meeting.

The Committee considered application S/2020/0945/MAO for the demolition of the existing buildings; erection of up to 26 dwellings, a new vehicular access off High Street, public open space, landscaping and associated works at Land to the rear of 27 High Street, Paulerspury NN12 7NA for Rainier Developments Limited and National Westminster

A pre-recorded address from Maggie Down, a local resident, speaking in objection to the application, was played to the Committee.

 

A pre-recorded address from Stuart Wells, Agent for the applicant, speaking in support of the application, was played to the Committee.

 

It was proposed by Councillor Sandra Barnes and seconded by Councillor Paul Wiltshire that application S/2020/0945/MAO be refused contrary to officer recommendations as the application is contrary to the Development Plan and is outside the village confines.

 

In reaching its decision the Committee considered the officer’s report and presentation, the addresses of the public speakers and the written update

 

Resolved

 

(1)  That application S/2020/0945/MAO be refused contrary to officer recommendations for the following reasons:

 

1. The application site lies outside the settlement confines of Paulerspury as   designated in the adopted South Northamptonshire Local Plan (Part 2) and is          therefore in open countryside. The adopted Development Plan seeks to focus       new development within the settlement boundaries of settlements and the      development proposed would therefore conflict with an up to date and adopted        Development Plan, in particular Policy R1 (g) of the adopted West      Northamptonshire Joint Core Strategy 2014 and Policy LH1 of the adopted    South Northamptonshire Local Plan (Part 2). In addition, to permit the   development would conflict with paragraphs 12 and 47 of the National          Planning Policy Framework.

 

2. Policies INF1 and INF2 of the West Northamptonshire Joint Core Strategy 2014 are concerned with infrastructure and developer contributions, and state that 'developers will be expected, in negotiation with the Local Planning Authority to make provision for related infrastructure and community facilities the need for which arises from the development’. This is consistent with the National Planning Policy Framework. In the absence of a signed legal undertaking the Council cannot be satisfied that the development proposal would make sufficient provision to mitigate the impacts of the development on existing community services and infrastructure serving the development including early years and primary education infrastructure; affordable housing; public open space and facilities (including maintenance); public transport and rights of way; refuse/recycling infrastructure; libraries and primary healthcare infrastructure. The application is therefore contrary to Policies H2, INF1 and INF2 of the West Northamptonshire Joint Core Strategy 2014, Policies LH8, INF1 and GS1 of the South Northamptonshire Local Plan (Part S/2020/0945/MAO - 2 - 2) and the adopted Supplementary Planning Document ‘Developer Contributions’ (December 2010).

The Committee considered application S/2020/0670/MAF for the construction of 19 x 2 & 3 bed social rented and shared ownership houses and all ancillary works at land to the rear of 2 to 26 Grays Lane Paulerspur for Grand Union Housing Group.

Minutes:

The Committee considered application S/2020/0836/FUL for a proposed change of use of land to create a 4 Pitch Gypsy/Traveller site comprising the siting of 1 Mobile Home, 1 Touring Caravan, and the erection of 1 dayroom per pitch at land east of Northampton Road, Yardley Gobion, NN12 7UE for Mr D Moran.

 

Councillor Ian McCord, Local Ward Member, addressed the Committee in objection to the application.

 

In reaching its decision, the Committee considered the officer’s report and presentation, and the address of the Local Ward Member.

 

Resolved

 

(1)  That application S/2020/0836/FUL be refused for the following reasons:

 

1.      The Travellers’ Accommodation Needs Assessment (January 2017) demonstrates that there is no need for any additional pitches in South Northamptonshire for Gypsy and Traveller households that meet the planning definition. The applicant has failed to provide adequate information for the Council to properly assess the essential need for the provision of the four pitches on the site. The development is therefore contrary to Policy LH11 (2) Gypsies, Travellers and Travelling Show People of the South Northamptonshire Local Plan (Part 2); Policy S1 Distribution of Development, S3 Scale and Distribution of Housing Development, S10 Sustainable Development Principles of the West Northamptonshire Joint Core Strategy 2014; paragraph 24 of the Government advice contained with Planning Policy for Traveller Sites August 2015.

 

2.      The residential vehicle access to the site is onto the A508 which is a Class A road which is contrary to the adopted Policy within Northamptonshire County Council Highways, Transport and Infrastructure Network Management Plan 2013, which aims to resist the creation of additional accesses or junctions onto Class 1 roads in the interests of highway safety and the expedient free flow of traffic. Furthermore, the failure to provide the site access with a dedicated right turn lane results in an access below current Northamptonshire County Council highway standards to the detriment of highway safety contrary to Policy LH11 (a) Gypsies, Travellers and Travelling Show People, Policy SS2: General Development Principles of the South Northamptonshire Local Plan (Part 2); andParagraph 26 of the Planning Policy for Traveller Sites, August 2015.

 

3.      The site is located unsustainably outside the confines of the village of Yardley Gobion and all journeys to and from the site would be likely to be made by private motor vehicles and due to the remote rural location of the site there is no safe walking route from this site to the facilities to be found within the village, contrary to Policy LH11 (b) Gypsies, Travellers and Travelling Show People, Policy SS2: General Development Principles of the South Northamptonshire Local Plan (Part 2);  Paragraph 26 of the Planning Policy for Traveller Sites August 2015 and Government Guidance contained with the NPPF.

 

4.      The proposed development, by virtue of its open countryside location would cause detrimental harm on the character and appearance of the open countryside and special landscape area.
